Ep. 31: The First Piece · Why Your Incident Report Builds the Case

Most organized retail crime cases fall apart because the paperwork underneath couldn't carry the weight. Don Carr and Jim Cords dig into a truth most store-level operators never hear: the incident report isn't what you do after the real work, it's the deliverable. The ORC cases that reach a task force or a prosecutor are built on a pattern, and that pattern is only as strong as the individual write-ups feeding it. A clean one becomes part of something bigger; a vague one is a dead end with a case number. The one thing fully in an operator's control: treat every write-up like the first piece of a case that doesn't exist yet.

So, Don, I'll tell you one thing that surprised me most coming into retail from the federal side. The ORC cases that fall apart. Most of the time it isn't because the crime was weak. The crime was fine. The case died because the paperwork underneath it didn't hold the weight.

Jim, expound on that a little more because I don't think that's where a lot of people think the failure actually is.

Okay, yeah, you're right. I think many people think the case lives or dies on catching them in the act. And catching in the in the act does matter, of course. But you'd be amazed how often there's a real crew, a real pattern, and it goes nowhere because the right episode behind it were just too thin to build a case on. So that flips the usual conversation, Jim, because a lot of the ORC talk goes straight to the big picture. The cruise, the scale, and it can leave the store-level person feeling like a spectator a lot of times. Like there's nothing that they can really do that actually helps move that needle.

Yeah, and they're the ones that are often holding the thing that matters most. The quality of what you produce out of your own incident, that's not a footnote to the case. In a lot of cases, it is the case.

Right. So let's walk through it. How does an RRC case or a lot of these high-level cases in general, how do they actually come together?

SPEAKER_01 2:42

So a single incident in a lot of jurisdictions looks like a low-level misdemeanor. Under that felony threshold, not really a priority up on its own. The ones that go somewhere that maybe a task force or a prosecutor can really work with are generally the ones where a pattern gets established. Same cruise, same method, across incidents and across locations. But I want to be careful because the thresholds and how this aggregation works generally vary state to state. But broadly, it's the pattern that gives the case its weight.

Well said, Jim. And that pattern is really only as good as the pieces feeding it, right?

SPEAKER_01 3:26

Yeah, and that's the whole thing. So you document an incident well. A clean description, good images, details tied to what actually happened, the time, the specifics, and you're not just closing out your own report. You've made something that connects to the next one. A vague write-up really connects to nothing. It's a dead end that happens to just have a case number.

A dead end with a case number. And I'm sure this happens a lot more than we care to admit.

Yeah, right. Absolutely. Probably a lot more than than that people want to admit. But it's not because they're they're lazy. It's because nobody told them the report was the point. They think the report is the thing you do after the real work. It's actually the deliverable.

So that store level write-up is really the raw material for everything upstream of that, right?

SPEAKER_01 4:23

Yeah, absolutely. I like that as well said, everything upstream. Investigators, task forces, prosecutors, they build with what they're handed and really nothing else. And a lot of the time, the difference between a case that gets made and a case that dies is just whether that documentation underneath it was any good.

So let's make it concrete here, Jim. What separates a piece of information that's usable from one that can turn out useless?

Okay. Well, contribute what you can actually support. What was observed, when it happened, tied to a specific incident. Not a hunch, not this guy seemed off, but you need articulable facts and just you know something to base it on. Because what you produce might end up as investigative and investigative information, a description, an image, sometimes a name, and its value depends entirely on it being accurate and made in good faith.

Well said, Jim. And is it fair to say that that accuracy cuts both ways? It can help the case and protects the operator at the same time.

SPEAKER_01 5:37

In a lot of cases, yeah. Accurate good faith reporting is generally well protected and it's what the system runs on. Where people can get into trouble is careless information. Something inner that's just wrong. That doesn't help anybody, and it can create its own problems. So it was never about doing less, it's about making sure what you produce is on solid ground.

Making sure what you produce is on solid ground, indeed. And this is the standard under everything we talk about here: reasonable, documented, something you can stand behind.

Yeah, same standard every time. That's why it's a standard. And it's the one part that's entirely yours. You don't control the crew, you don't control the whole picture, you control whether your piece of it can hold weight.

So the thing to leave people with is that incident that looks just like another bag out the door. Assume it's not the last time you'll see that crew. And write it like it's going to matter later. Because a lot of the time it does end up mattering later.

Yeah, every write-up is the first piece of a case that doesn't exist yet, and treat it that way.
